Entrenched?

We interact or not for reasons that might not be apparent to others or even to us. But if we want and feel to get something resolved in a difficult relationship whether voluntary or not, we had better focus on the steps to get that done. If negotiation between disputants could not begin or goes nowhere, mediation by a neutral and impartial mediator in a new context provides the impetus.

To prepare for any mediation, the disputants need to identity the issues of the dispute and to possess sufficient evidence to prove the assertions. Not only have they to assess the strengths and weaknesses of their cases, but they also have to consider the appropriate exchange of offer in the circumstances eg the amount of compensation. A mediator assists the disputants to identify and recognize their best or worst alternatives in a spectrum of feasible resolution options so that they can optimize their respective outcomes.

In my observation, uncompromising positions and bad feelings between disputants entrench if there was no meeting of the minds in their initial negotiations. Instead of allowing a downward spiral draining money, feelings and time, facilitated negotiation via a reputable, credible and proactive mediator should uplift everybody and should enhance the likelihood of agreement. Just leave the past behind, act timely and move on!
